For Trials

We would assemble
several focus groups each of which would serve as a proxy jury. Each focus
group jury would be composed of a different demographic makeup.

The focus
groups would be carried out in a facility
located in a neighborhood whose socio-economic and demographic characteristics
reflected the likely composition of the real jury. The facility selected
would contain a two way mirror through which we could study the reactions of
jurors to various aspects of the case, but the jurors would be unable to see
us.

We would provide a
professional "facilitator" experienced with directing groups of people. The
facilitator would conduct the focus group sessions, administer questionnaires,
and focus the discussions and deliberations of the group to ferret out issues
of importance in the case. Focus group sessions would each take several
hours.

In each focus group
session:

the case would be
presented by two different attorneys via two videotapes, one for the
plaintiffs and one for the defense;

there would be a
deliberation of the issues in the case by the focus group jurors, aided by
the facilitator; and finally,

there would be
voting on the case by jurors using written questionnaires specially crafted
by us for your case.

We would collect
questionnaires from all of the jurors and develop a statistical analysis of
the respondents in terms of how they voted on the various questions, and how
their votes might be predicted from their background characteristics.

On the basis of the
focus group session results we would develop juror profiles
of which type of potential juror is
likely to be
undesirable and
desirable.

For Market Research

We would develop a group of people who
could be used to help evaluate a new product, the possible location of a new
facility, a new marketing strategy, etc.
Voir Dire
Questionnaires

In some cases you
might like us to use our survey expertise develop a custom-designed voir
dire questionnaire to be administered to members of the jury pool. The
questionnaire would be designed to ferret out perspective jurors likely to
be unfavorable to the prosecution. We would plan to use a scoring system
(live, during voir dire) that we have developed and honed for rating each
prospective juror regarding his/her degree of likely favorableness to the
prosecution. We would communicate the scores to the attorney through an
intermediary. This technique is, of course, designed to assist you to make
the most effective use of your peremptory challenges.
