Yesterday the Supreme Court held that a suspect who never signed the
form waiving his Miranda rights, and maintained silence for 3 hours, nevertheless could be questioned (and his eventual ambiguous
confession admitted in court) because he failed to assert his rights explicitly. How unfortunate. As we learn more
about the staggering frequency of false confessions, the Court reduces protection against them.
