2nd Step Grievances

Fin04-006 Failure to address issues
Un. We talked with the steward of the area and every one of these items was brought up to the supervisor. They were discussed at the start up meetings and they were also told to the supervisor
Co. We would like to take this one back to Step1/2 with the manager, facilitator, steward,
Un. We would like to bring in someone from the area and the night chief steward along with the President of the union.
Co. We will set up meeting for sometime this week.

Fit for Duty
Un. We have asked for the criteria the company is using to bring people in, to have them come in and talk to management about this “Fitness for Duty”  thing.
Co. Some of the things we look at are the drug and alcohol program guidelines, physical limitations and another is other people seeing a problem and wanting it checked out.
Un. That could be a witch-hunt
Co. A witch-hunt would be something unproven. When there are things that are visual to others I will talk to the individual and see if there is anything to be concerned about. The company will be leaning to the side of safety of other employees. We are concerned for the employees. We want to make sure that in general all employees are being taken care of.

Pay checks for Holiday week
Co. As soon as we get them in
Un. Direct deposit, paperless, Supervisor read an E-mail about not receiving a check stub
Co. Anyone with an E mail address would have received that E mail but hourly people will have the option of direct deposit or a regular check

D1F- UPS
Co. We believe now we will receive that engine the 1st week of December.
Un. That was an engine from next year.
Co. Yes
Un. Affect the TVLOW
Co. We don't see anything changing because of this engine

Temporary Limitation
Co. There is a new policy that is going out to all the engine transportation facilities. There will be a limit on people who have restrictions from 6 to 12 weeks maximum. This will not bypass any union contract obligation that we have. We will be putting this policy out with the checks.


End of meeting

There will be No 2nd Step Negotiations until the 1st of the year unless it is necessary.

Un. We received your answer

2nd Step Grievances

Co. The person did give up his recall rights to 2nd shift machinist but that really does not matter in this case. The person bid and got a job in calibration then later on he was surplused. At that time he did not have enough seniority to go to the highest rated job that he had held which was machinist so he had to move down to a R25 rate. Since he had to bypass the highest rated job that he could go to he at that time regained his recall to that classification.
Un. For the record he did not hold that position the machinist after he was surplused.
Co. But he was of an equal rate, which if he had the seniority would have put him back into that classification. Since he was surplused he would regain all areas that he could work with the highest rate that he could hold.
2nd step answer

EMU04-003 Points
Un. There has been times where people have been given no points no pay for reason such as road closures or snow days.
Co. If that is true I will not give points for this day but before I do that I need to know which foremen have been doing that.
Un. It's suppose to be per the attendance guidelines if a person is having problems with points the foreman contacts you and you look at each individual circumstance to determine if no points should be given.
Co. No supervisor has approached me on this. I would look at it but I don't believe I would change anything unless it affected the whole facility
Un. There were individual cases where no points were given when we had the fires last year.

UR04-007 Unjust termination
Un. We firmly believe that the company knew about this situation. He also believes he was on maintenance of equipment in 2002 when most of this was done. Someone else told you that a lot of this was done right after the move up there and was done on maintenance of equipment. We believe management was well aware of all the things that were going on up there and chose to not see.
Co. The cameras were the main reason for termination. He was addressed early in the year for security reason about a cell phone with a camera.
Un. We don't believe there should be cameras however he was not taking any type of pictures. Based on his long service and work record we would like him brought back.
Co. I will take this to the management and I will give you a 2nd step answer

Fin04-006 Failure to address issues
Un. Here is a list of some of the complaints and issues that final assembly is having with manuals, tooling, etc.
Co. For the record when the facilitator asked the steward how to correct this grievance the steward would not response. If the steward is unwilling to discuss the problem then I see no reason to have a 1st step grievance procedure.

Un. We understand what you are saying, we would like to table this and talk to the steward.   We will then see what would be our next step.  But looking at these issues most of these have already been brought up at the start up meeting with no changes.

Un. We would like a copy of the guidelines as to what is fitness for duty.
Co. No problem
Un. How do you decide if someone is fit for duty?
Co. Based on visual things. There has to be a reason to question somebody's mental or physical being.
Un. We don't want this to be some kind of witch-hunt.

Work load for Facility
Co. We do not see anything coming in until January. We thought we were going to get two engines but that company ran out of money.  We are looking into several options.
Un. What about TVLOW's
Co. That is one of the options we are looking at. 

Un. If anything is necessary we would like you to look into asking people to take a TVLOW.
Co. We are still looking into options right now.
