NRC Lies In the Ron Bath vs the NRC Case
and
Why They Go Unchallenged

To date, Congressman Edward J. Markey has written and sent 3 congressional letters of inquiry to The NRC:
 
 
NRC Chairmen Meserve and Diaz responded to all 3 letters with lies, misstatement and deception. 
 
Unfortunately, there has been no follow up or rebuttal to the last ridicules response that Congressman Edward J. Markey received from Commissioner Nils J. Diaz several months ago. 
 
 

An Analysis and Rebuttal to:

Summary:

 

Mr. Diaz has provided a chronological compendium of my actions taken in my legal struggle for justice.  I am sure that none of this was news to Congressman Markey or my attorney Billie Pirner Garde.  It certainly wasn’t to me.

 

Mr. Diaz did not provide factual and forthright answers to Congressman Markey’s request.  His answers were a parroted copy of old and already gleaned accounts of past events.  It was obvious that no attempt was made to update this history with later discoveries and no correction of misimpressions left standing.

 

It was evident that Mr. Diaz had not read, or at least admit to reading the case OIG investigative reports.  Had he done so, he would not have represented so many erroneous  bits of information as the truth.

 

This reply is crafted to appease the good congressman.  It is not what the congressman asked for and he should not be content with it.

 

Congressman Markey asked the question of why my case hadn’t been settled.  He and I are left asking the same question even after the receipt of the NRC’s letter of response. Mr. Diaz did not answer the question.

 

The congressman urged the NRC to take expeditious action to resolve my complaint in a manner acceptable to both sides.  Mr. Diaz made no appearance of doing as the Congressman asked.  Still under consideration after one year is a non answer. They have been in deliberation for exactly one year now.  It is time to force a decision or go to court.

The last letter of inquiry, dated November 3, 2003, asked over a dozen detailed questions requiring detailed responses from Commissioner Diaz. 
 

I several months ago, I read an "official turn down letter" that  Chairman Nils J. Diaz, of the US Nuclear Regulatory Commission sent my attorney, Billie Pirner Garde.  It was sent shortly after Chairman Diaz sent a letter of reply to Congressman Edward Markey (D) MA which was essentially a scam, in my opinion and belief. Its brevity made  quick reading.  His answer to my request was No!  At least that was the bottom line to his "weasel worded" reply.

 

In his response to this third letter of congressional inquiry, over a dozen detailed questions requiring detailed responses were ignored with wording that made it appear that he could not respond due to my "pending" legal claim with the NRC being under their consideration. To add insult to injury, Chairman Diaz's letter of response was almost two months late for the "no later than" date requested by Congressman Markey for Diaz's reply. 

 

Diaz surely knew he was planning to deny my Tort Claim, and merely used this ploy to keep from answering, in my opinion and belief, some very embarrassing questions about his organizations' highly questionable actions with respect to my being fired.

 

Today I am heartsick over a decision I made in 2000 that has ruined not only my life, but that of my family. It was my decision to do the right thing;to turn in employees of the Nuclear Regulatory Commission for felony criminal misconduct.

 

My decision cost me a year of unemployment, the loss of my home,the loss of my life savings, and the loss of my health.

 

A Bill was amended in Congress by Congressman Markey (D-MA) in my name. The NRC refuses to admit their illegal firing me in retaliation. They have, in my opinion and belief,  obstructed justice and lied to the Congressman.  The FBI and Secret Service arrested the 3 NRC officials due to my allegations to the Office of the Inspector General's office.

 

On March 18, 2004 I communicated with Congressman Markey's Staff and requested that a response be prepared and sent to Commissioner Nils J. Diaz addressing his latest deceit and refusal to answer the specific questions that the congressman asked of him.

 

My Message, in part:

 

I respectfully request that you and congressman Markey proceed with rebuttal or further appropriate action in my case with Chairman Nils. J. Diaz and the NRC.

It doesn’t seem fair to impede progress in my case by yoking me to that of others.

My rationale:

  • My case started over 3 years ago, while other cases are of recent vintage
  • I was never accused of wrong doing, and others were
  • A letter of response has been received by congressman Markey from Chairman Nils J. Diaz that essentially was crafted to dodge the many serious and compelling questions that congressman Markey asked him about my case
  • My claim has been officially turned down by the NRC, no justice for me
  • Obstruction of justice has been perpetrated and is just waiting to be investigated

The staff responded by essentially telling me that they were too busy working on crafting letters about more important matters (cases) than mine.  Human rights and honor took a backseat that day, and appearances are that nothing more has been done in the good congressman's office about my case, Ron Bath vs the NRC..

 

I have quite a heart wrenching story to tell of how a government agency turned making the right decision into hell for an honest citizen.
