OBITUARY

Timothy Desmond, a retired stevedore, for sixty-five years living in one section of the Twelfth Ward and one of its most highly respected citizens, died at his home, 449 Columbia Street, Monday. He had just returned from visiting a bereaved family as was his custom every Monday, when he was stricken with final illness. His daily recreation for years was driving fast horses down the Ocean Parkway, and he was known to all the owners of trotting horses in Brooklyn, being a familiar figure at all trotting meets. Years ago Mr. Desmond was one of the best known stevedores along the river front. He had been a member of the Church of the Visitation since the establishment of the parish and was a trustee of the St. Vincent de Paul Society and the Holy Name Society. He belonged to many other Catholic societies in which he was a faithful worker. He leaves five sons, Daniel, Timothy E., Matthew, Dennis and Francis; two daughters, Mrs. M.B. McPartland and Mrs. Thomas A. Clark; twenty-two grandchildren and five great-grandchildren. He was a native of County Cork, Ireland, and came to Brooklyn when a lad. A requiem mass will be celebrated at the Church of the Visitation to-morrow morning at 10 o'clock. Interment at Holy Cross Cemetery.

LAST WILL AND TESTAMENT

In The Name Of God, Amen.

I, Timothy Desmond, of the County of Kings, City and State of New York, being of sound and disposing mind and memory, and considering the uncertainty of this life, do make, publish and declare this to be my last Will and Testament as follows:

First, after my lawful debts are paid, I give and bequeath to my daughters, Mary McPartland and Norah Clark and to my son, Timothy, the sum of two thousand dollars each and I hereby make these legacies a charge upon my entire estate, real and personal.

Second: All the rest, residue and remainder of my estate, real or personal or both I give, devise and bequeath to my sons, Daniel, Matthew, Frank and Denis, in the following shares: one third to Daniel, and two ninths each to the other three.

Third: I hereby give to my executor full power to mortgage or sell any or all of my real property for the purpose of paying the above first mentioned legacies, or if desired by any of the residuary legatees, for the purpose of obtaining their shares.

Fourth: Any benificiary named in this will who shall contest this will shall thereby forfeit any and all benefit which he is hereby given under it.

I hereby appoint my son, Daniel Desmond, to be Executor of this my last Will and Testament: hereby revoking all former Wills by me made.

In Witness Whereof, I have hereunto subscribed my name, and affixed my seal, the 17th day of October, in the year of our Lord, one thousand, nine hundred and three.

Subscribed by Timothy Desmond the Testator named in the foregoing Will in the presence of each of us, and at the time of making such subscription, the above Instrument was declared by the said Testator to be his last Will and Testament, and each of us, at the request of the said Testator and in his presence and in the presence of each other, signed our names as witnesses thereto.
