HSUS Files New Fur False Advertising Complaint with the Federal Trade Commission
 
More Than 20 Companies Now Facing Potential Civil and Criminal Penalties
 
WASHINGTON (April 24, 2008) – The Humane Society of the United States filed a legal petition with the Federal Trade Commission today seeking criminal and civil penalties against more than a dozen nationally known retailers and fashion designers for the false advertising and mislabeling of raccoon dog and other fur garments. The HSUS filed a similar action against 12 retailers and designers last year, including five companies that are also named in the latest petition.
 
“The epidemic of false advertising in the fur industry only seems to be getting worse,” said Kristin Leppert , director of the fur-free campaign for The HSUS. “How many raccoon dogs will be skinned alive and sold as faux fur before this unconscionable behavior comes to a halt?”
 
More than 20 companies have now been named in the FTC proceeding, including nine that were added in the latest filing: Bloomingdale’s, Inc.; Caché, Inc.; Dr. Jays, Inc.; ELuxury.com, Inc.; Pasha & Jo; Ramosport; Saks Incorporated; Sears, Roebuck and Co.; and Yoox S.p.A..
 
Over the last three winters, The HSUS has identified dozens of falsely advertised or falsely labeled garments—70 percent of which contained fur from the raccoon dog, an Asian member of the dog family, that has been documented to be skinned alive in China. Among the false names used for raccoon dog fur are: Faux fur, Ecological fur, Polyester, Coyote, Rabbit, Canis Latranis, Raccoon and Finni Raccon.
 
In the U.S. Congress, Reps. Jim Moran (D-Va.) and Mike Ferguson (R-N.J.) have introduced the Dog and Cat Fur Prohibition Enforcement Act—H.R. 891—that would require labeling of all fur garments regardless of value, and would ban the sale of raccoon dog fur. The bill has 163 co-sponsors in the House, and The HSUS calls on Congress to act swiftly to pass this much-needed reform.

  • The raccoon dog has been documented being skinned alive for the fur trade.
  • The Federal Trade Commission is tasked with enforcing the Fur Products Labeling Act and protecting consumers from deception.
  • It is illegal to import, export, sell or advertise any domestic dog fur in the United States .
  • Under current law, fur must be identified with a label, but only if the value of the fur exceeds $150. Once fur is identified on a label or advertisement, regardless of value, the species must be accurately disclosed.
  • "Asiatic raccoon," although not the accepted common name in use by the scientific community, is the name required under federal law in advertising and labeling of fur garments made from the raccoon dog.
  • Raccoon dogs are not raccoons (Procyon lotor) — they merely have facial markings that resemble raccoons.
  • Raccoon dogs (Nyctereutes procyonoides) are a member of the dog family. Indigenous to Asia, including eastern Siberia and Japan , these small, fox-sized furry animals seem to enjoy social contact.
Timeline:
 
  • Dec. 20, 2007 – The HSUS published results finding that many leading retailers—including Bloomingdale's, Neiman Marcus, Lord & Taylor, Dillard's, Saks Fifth Avenue and Yoox.com—were selling certain jackets with the brand names Burberry, Andrew Marc, Marc New York, Preston & York, Aqua, Ramosport and Adam+Eve that were falsely advertised or mislabeled as faux fur or "ecological fur" when in fact they are trimmed with real animal fur.
  • Aug. 15, 2007 – Former New York Governor Eliot Spitzer signs legislation requiring all clothing that includes fur or faux fur sold in New York State be correctly labeled as being "faux fur" or "real fur." The law went into effect Nov. 13, 2007.
  • March 13, 2007 – The HSUS petitions the Federal Trade Commission seeking penalties against 14 retailers and designers for violation of the federal Fur Products Labeling Act. Due to subsequent remedial measures that Foot Locker, Inc. and Michael Kors USA, Inc. implemented, The HSUS later withdrew those two companies from its petition. The petition is still pending before the FTC.
  • Feb. 7, 2007 – Reps. Moran and Ferguson introduce the Dog and Cat Fur Prohibition Enforcement Act in the U.S. House of Representatives.
  • Dec. 2006 – Tests commissioned by HSUS investigators find raccoon dog fur on jackets being advertised as "faux" and/or labeled as other species, such as raccoon or coyote.

DONNA KARAN'S DUBBED 'BUNNY BUTCHER' BY ANIMAL ACTIVISTS

Animal rights protesters have left a graffiti attack outside fashion designer DONNA KARAN's New York home.

A group called the Paint Panthers have sprayed abusive messages on streets surrounding her house in the Hamptons, on New York's Long Island - including "Bunny Butcher", a reference to her use of fur in her creations.

People for the Ethical Treatment of Animals has denied any link to the attack, but are long term critics of Karan. PETA president Ingrid Newkirk says, "If Donna Karan stopped making clothes out of tortured bunnies, we'd be out of her life faster than you can say, 'Yoga mat'."

Bite Back started the Scapa campaign 1 year ago against the fur selling (rabbit fur coats and fur trimmings) international fashion chain Scapa. Around 45-50 shops in Belgium and Holland, Scapa clothes are also sold in 100 other shops, also in Spain, France and Denmark.
 
Last week we had a meeting with the Scapa CEO. Yesterday they sent us a fur free declaration: they (all their collections) will be fur free from winter 2008 and
they stop selling fur - in the exclusive Scapa stores - from today.

Fur is not fun in spite of the fashion industry's attempt to market it that way.  Rabbits and other animals in fur and meat farms have miserable, short lives. They  are slaughtered by electrocution or having their heads bashed against a wall. Then a few incisions are made in the fur, and their skin is literally ripped off of them. Since the killing methods are imperfect, it's inevitable that some rabbits are still conscious when their fur is removed.  Governmental oversight of the fur industry is minimal, enforcement is lax, and prosecution unusual.

Fur vendors frequently claim that the fur is a "by-product" of the Chinese meat industry. That's deceptive. The fur is a product, not a by- product, because it generates revenue and it encourages more breeding of rabbits. Furthermore, rabbits with the thicker fur desired by designers and manufacturers are not necessarily those bred for meat. The bigger the market is for rabbit fur, the more likely that rabbits are bred primarily for their fur.

DO NOT BUY THE LIE!

The fur trade has tried to justify its inexcusable behavior by perpetuating the myth that rabbit fur comes from rabbits bred for the meat industry and as such is a waste product.

This is an outright lie instigated by the fur trade to try to justify the unjustifiable. The fur from rabbits bred for the meat industry is not deemed good enough to use for clothing and footwear products.  The rabbits are killed at around 12 weeks of age.  At this age, the rabbits' coat is not thick enough.  Rabbits bred for fur are killed at 8 months of age at the earliest, after they have shed their first winter coat.

Do not buy any item made from rabbit fur or angora wool. Juvenile rabbits, age 5 months to one year of age, are slaughtered because this is the age when their fur is the softest since they haven't fully developed guard hairs.

Other animals also suffer terribly.  PETA recently released shocking footage from a recent investigation into the Chinese dog and cat fur industry, in which millions of dogs and cats are bludgeoned, hanged, bled to death, and strangled with wire nooses so that their fur can be turned into trim and trinkets. Their fur is often mislabeled as that of other animals, often rabbits, and exported into the United States, the European Union, and other countries, where it may be sold to unsuspecting customers.  Retailers and designers purchase fur from China, supporting the hideously cruel fur trade.  In 2005, PETA campaigned against J. The fur animals in China suffer one of the most cruel and savage practices directed against defenseless beings.  The murderous practices are hidden from unsuspecting consumers who may not know that each fur article comes with an unimaginable amount of agony, all in the name of fashion.   This cruelty must not be tolerated.   You can protest directly to the Chinese Embassies worldwide at:
 
 
Fur is entirely unnecessary. Synthetics look great, feel great, and are cheaper to produce. Fur is currently being heavily marketed, which drives up demand. The solution is to reduce demand. One of the most effective ways to do that is to let people know about the suffering that goes into every fur garment and to remind them that faux fur is a widely available attractive substitute.

Here's what you can do:

**Always check the label when buying anything that resembles fur, including cat toys, gloves, handbags, and figurines. If the label does not specifically indicate that the item is made from synthetic materials, don't buy it. It might be made from rabbit fur.

**Let retailers know that their fur items offend you.  Ask to be removed from mailing lists. Cut up and return your store credit card. Politely complain to salespeople. Some may feel the same as you.  Write or e-mail the management of the offending stores to complain.  Keep in mind that personal letters are usually more effective than e-mails.

**Educate yourself about the horrors of fur, and enlighten skeptical friends and family members. Find out who the fashion designers are that still use fur.  Find out what celebrities still wear fur.
