Waiver: I have read the waiver, Initials	Standard agreement for facility use. The user assumes all liability and agrees to indemnify and hold harmless Hill School, the Board of Trustees, officers and agents (see below) from any and all claims. 1. The User shall comply with all ordinances, statutes, and regulations of all local, State, and Federal authorities and agencies, and the User hereby agrees to defend, indemnify and hold harmless the School, its Board of Trustees, officers and agents from all penalties, fines, costs, damages and expenses resulting from failure to comply. 2. The User shall defend, indemnify and hold harmless the School, its Board of Trustees, officers and agents from and against any and all claims, liability, loss, damage, and demands, whether involving intentional misconduct, negligence, or otherwise, arising out of or resulting from use of the Facilities, or resulting from any acts or omissions by User or its agents, employees, guests, licensees, invitees, assignees or successors. 3. The User assumes responsibility for all Campers, participants and/or spectators for liability/injury resulting from incidents or accidents on or at the Facilities. The User further agrees that all use of the Facilities shall take place on a "Use-At-Your-Own-Risk" basis, and agrees to defend, indemnify and hold harmless the School, its Board of Trustees, officers and agents from all claims, liability, loss, damage, and demands, whether involving intentional misconduct, negligence, or otherwise, arising out of or resulting from the User's use of the Facilities. 4. The User shall provide adequate supervision to conduct the Events and its programs and to supervise the dormitories and the Campers. User shall be responsible for the actions of all Campers, counselors, supervisors, instructors or other employees or independent contractors of the User. 5. In the event that the School has any complaints of a disciplinary nature regarding the User's Campers or personnel, the School has the right to communicate the problem to the User and ask that the User take appropriate action. 6. The User and the building superintendent of the School will conduct an inspection of each Facility used by the User prior to and after completion of each Event in order to assess any damages which might have occurred through the use of such Facility, normal wear and tear excluded. All such assessed damages shall be the responsibility of the User. 7. The User shall furnish to the School evidence of insurance coverage, thirty (30) days in advance of the Event, as follows: a.Worker's compensation or other coverage, which in the sole opinion of the School's counsel, provides full and adequate protection to the User's employees without in any way leaving the School liable for claims against it; and b. General public liability insurance, insuring the School, its Board of Trustees, officers and agents, against any and all liability or claims of liability, arising out of, or occasioned by or resulting from the operations of the Event on the Facilities or elsewhere, for injuries to any person or persons, including Campers, and employees and agents of the User, or injuries or damage to property, for limits not less than two hundred fifty thousand dollars ($250,000) for injuries to one person, one million dollars ($1,000,000) for injuries to more than one person, and property damage for limits of not less than ten thousand dollars ($10,000) in any one accident or occurrence; 8.The User is responsible for providing at its expense all required medical supplies, medical personnel, and medical insurance. * required
