In the course of human events it becomes inevitable to stand up and take action.  Some actions require the dissemination of information to inform and educate the masses.
The Commonwealth of Massachusetts is at a crossroads.  First there was tha Mashpee Wampanoag Middleborough Resort Casino that has failed under a February US Supreme Court ruling.  Our Governor Deval Patrick set out last year to bring 3 commercial resort casinos.  That crashed and burned under senior legislative weight.  Now gambling bills arise again.  Casinos, racinos and/or slot parlors.  The battle is continual.  I hope to display and comment upon effectively quotations from various individuals their convictions and attitudes on this pressing subject.  May it educate, inform and entertain you thoroughly.

Happy No Casino Year
 
This has been my first full calendar year of blogging about casino issues and more specifically the proposed Mashpee Wampanoag Middleborough Resort Casino.  2008 has been an amazing year for being in the forefront of the casino issues.  I've been able to meet with some fantastic dedicated people who care about their communities enough to not only not want a casino in their back yard, but also not in anybody's back yard.  I've felt the presence of those who vehemently disagree with my stance and consider it a pleasure to be noticed enough to have their barbs thrown my way.  They need to know it doesn't bother me one bit.
What was accomplished in 2008?
1. After 20 months since the plans surfaced, there is still no casino.  Even though Scott Ferson, the Mashpee's paid spokesman stated they would start building in 18 months.
2. Began petitioning my legislators on how wrong it was for the state to even consider casino gambling as a legitimate source of revenue for the state.  And, then watch Gov. Deval Patrick's 3 casino plan go up in smoke.
3. I participated in my first federal public hearing in March as the Bureau of Indian Affairs heard my comments and the throng of others who opposed any such use of the land for a casino.  The proponents were out numbered 3 to 1.  To be "accidentally" elbowed afterwards by one of the tribal members was an honor.
4. To organize and enjoy a sucessful No Casino Yard Sale in my town of Lakeville.  The ill-conceived notion by the chairman board of selectman to actually cut all groups off from using town property for fundraising activities was enlightening.  It brought to light Charles Evirs' true colors of being pro-casino and he would do anything to stop those who disagreed with him.  It was a pleasure to watch his plan back fire, with his arms crossed and red-faced.
5. A couple federal court cases came up that does and change much of what could be done in Middleborough. 
A. Kickapoo v Texas was ruled that any tribe wanting a casino can't get any form of gambling beyond what the state has without an agreement to do more.  No class III gambling means no class III gaming.  A bingo hall is all the Mashpee can dream of in this state right now.
B. Carceiri v Kempthorne, a Supreme Court case, soon to be published should nail the coffin shut on the Secretary of the Interior's "authority" to put land into federal trust over a state's sovereignty, specifically for tribes who were not part of the initial Indian Reorganization act of 1934.  The final decision won't be out until February, but it doesn't look good for the SOI and tribes, including the Mashpee.
6. The end of year CasinoFacts Gala was a moderate success.  The best part, besides the hanging out with fellow casino opponents, was the speech by Les Bernal of Stop Predatory Gambling.  A very enthusiastic speaker with an excellent understanding of the gambling industry and how it effects common man.
7. The indictment of Glenn Marshall, former chairman of the Mashpee Tribal Council.  This brings much more needed light to expose the corruption so deeply involved with this casino proposal starting back to 2003.  The money changing hands, investors, lobbyists, congressmen, other tribal leaders.  Marshall is only the beginning.  Prominent members of the tribe are readypatrickstar.jpg to purge the rest of the corrupt out.  But the Middleborough BOS just wants to "wait to get all their ducks in a row" before they make any decisions as to whether the IGA was made in "good faith" or not.  So what if Glenn Marshall was the front man and the investors and lobbyists were the ones making the agreement in the first place.  "Hey Spongebob, pass me another nail."
This will be an eventful year ahead.  I am looking forward to it.  My one big prediction for 2009 will be is that there still will not be a casino even started to be built in Middleborough.  Even if Scott Ferson says there will be one in 18 months.

What a wonderful wrap-up Carl!  I particularly liked being reminded of the yard sale and it's outcome.  Nice to see a selectmen with a private agenda being exposed and corrected.  Kind of gives one hope for Middleboro, doesn't it?

Native Woman Scorned
 
"While for many members of the Mashpee Wampanoag Tribe, Monday was a day of vindication, there are still those who believe Glenn Marshall was some kind of a hero. They believe he achieved something through bullying, arrogance, manipulation and illegal activity, including stealing money, that was much needed for tribal programs and services, something we could not have achieved otherwise." - Paula Peters is a member of the Mashpee Wampanoag Tribe
 
WOW!  Can Ms. Peters get any more scathing mad in her piece in the Cape Cod Times?  She has stated here ever so clearly what has been said by myself and others this past year.  The system is corrupt, the people involved are corrupt, the innocent are hurt and there needs to be a change.  In a nutshell she notes several things:
    • Unshun the shunned.
    • Their leadership was currupt and must go.
    • The needed funds for the tribe were misused.
    • The federal government system that was supposed to help tribes financially "...created a recognition process that is by far the most cumbersome, bureaucratic and expensive legal litmus test known to man. They created the Indian Gaming Regulatory Act in 1988, producing an environment where fledgling Indian tribes on the brink of recognition became ripe for the picking for greedy investors. They developed the congressional ballroom where lobbyists like Jack Abramoff penned in every vulnerable pending tribe on his dance card for fleecing and corrupting."

Hopefully the coming new year can bring some well needed change for the Mashpee Tribe and the rest of us who do not want a casino and the corruption the one proposed for Middleborough has brought with it.

The Call To Resign, Mr. Hendricks
 

Meanwhile, tribal council member Aaron Tobey, who is a Lakeville resident, said he has called on any member of the council or employee of the tribe who "has been involved with any of the illegal activities of Glenn Marshall or who made a political contribution and was reimbursed to step up and resign for the betterment of the tribe."

It was reported here first of the apparent involvement of current Mashpee Tribal Chairman, Shawn Hendricks in the illegal campaign contribution scheme to help win federal recognition initiated by Glen Marshall.  Mr. Tobey calls for you to resign, so the tribe can "take a huge step in the direction of healing" from what has tainted its reputation and put into doubt any agreements made by its leadership.  The tribe may be asked to reopen casino contract and federal recognition of the tribe is being questioned because that is what the money was to be used for.  Read this from the charges against Glenn Marshall on page 7.

30.  MARSHALL also hired Washington DC lobbyists recommended and paid for by ATMashpee to make the Tribe's case to members of Congress.  From time to time, these lobbyists arranged meetings for MARSHALL and others principals in the Tribe with Congressional staffs in order to discuss the status of the Tribe's recognition petition.  These lobbyists also recommended that MARSHALL and the other members of the Tribe make campaign contributions to certain Members of Congress and political action committees as part of the Tribe's effort to win support for the recognition effort.  From time to time, MARSHALL and others affiliated with the Tribe made such contributions.

The whole purpose to give contributions was to win the favor of congressmen with influence.  It is a shame that it is even entertained that in order to receive help from our elected officials that you need to give to their campaigns.  It doesn't say much about them either. 

As more about this mess is exposed and identities confirmed and guilty brought to justice, hopefully not only the tribe can be healed, but also the town of Middleborough and the rest of the region.  We saw this coming, but no one wanted to listen.

Fear Factor
 

“I know he didn’t pay me off.”- Middleborough Board of Selectman Chairman, Adam Bond when asked if he feared Marshall paid off local officials.

I believe him when he says it.  Read the Enterprise article here.  Mr. Bond is too smart and doesn't have the unethical underpinnings to get caught up in a Dianne Wilkerson type deal.  Or, even a Glenn Marshall type deal that has put a huge cloud (more like a mushroom cloud) on the entire proposed casino resort in Middleborough.  Casino Free Mass has sent a reguest to AG Coakley's office to investigate the whole thing from the beginning, from federal recognition to present day.  The investigation is not over by a long shot.  Everyone involved should be asked the question, "Did you take a pay off?"  Under oath, of course.  I sure hope that everyone who ever shook the had of Glenn Marshall washed their hands really could, because the investigation is still on going.

During one BOS meeting, Mr. Bond commented about returning a garment, maybe a fleece jacket or comparable item with a nominal value that exceeded the limit according to the state regs he reviewed.

At the time, I thought that rather than his public comment or the returning of the garment being praiseworthy, what of the other Selectmen? Would a person hearing of Mr. Bond's return of a garment not think that he was not singled out, but that each and every  one of the Selectmen also received a comparable item? Did that also include the former Town Manager? And what of meals and other gifts?
 
Mr. Bond is bound by rather stringent ethical standards that would jeopardize his license to practice law.  Assuming that the 'garment' was worth $35, who would jeopardize their livelihood for $35?  
 
It is my understanding that Marsha Brunelle, who was Chairman and Chief Casino Cheerleader at the time of the TMFH is a regular attendee, along with her husband, IT Director and Special Events Coordinator of the TMFH (for which there are no meeting minutes available), of the Foxwoods Casino. Were they granted preferential
treatment because of their status?  
 
There are questions that need answering and sincerest appreciation to CFO and Casino Free for insisting that now is the time to ask those questions.

The Day The Middleborough Earth Stood Still
 
“He (Glenn Marshall) needs more than a plea bargain, he wrecked our tribe.” - Amelia Bingham, a shunned Mashpee tribal member who first raised the allegations.
 
I have to say it, we told you so.  As much as those still drinking the casino Kool-Aid would like to think all is okay with the tribe and agreement with the town, the casino pact IS in peril.  Mr. Perkins better do some more reading up on the indictment and any future ones coming our way.  My prediction, as noted below, is that Shawn Hendricks is next, being one of the "straw contributors".  Adam Bond is looking for a way out.  Brian Giovanoni has reportedly resigned from C.R.A.C (Middleborough's Casino Resort Advisory Committee).  Pro-casino forums and commentators are shocked and awed into silence.  Except for a few diehards in denial.
 
What most realize is that the admitted offenses by Glenn Marshall is only the beginning of the end.  Money to corrupt lobbyist, congressman to gain federal recognition of a tribe (only to bulid a casino) that may not have ever gotten it, if it were not for all the payoffs.  This was shady from the beginning and we knew it.  Land deals, rammed through agreements, closed door meetings, vilifying any and all opponents, etc.
 
Amelia Bingham has been vindicated and should get her status back in her tribe.  Can the tribe now be restored from where its leadership has taken it?

Who could be next? Connecting the casino dots.
 
In order to disguise the source of the contributions, MARSHAL solicited various individuals to act as straw contributors, including members of his family and officers of the Tribal Council.  In each instance, MARSHALL asked the straw to write a check to a candidate's reelection committee, insisting that the contribution was necessary to further the Tribe's recognition effort and promising the straw contributor the the Tribal Council would reimburse him or her for the contribution.  MARSHALL himself also made such a straw contributions. - Page 10, item 43 of USA v. Glenn A. Marshall
 
This had me wondering, who is "officers of the Tribal Council" as mentioned and who were they giving contributions.  I did some research.  The following are contribution totals MARSHALL made of $250 or more from the periods of 2003-2006.  Courtesy of Newsmeat.

Pay special attention to Pombo.  His PAC is listed as Political Action Committee A in the report.  Pombo was knee deep in the Abranoff scandal.
Corruption allegations

Pombo and his political action committee RICH PAC[19] are among a dozen leaders in the House of Representatives reportedly under investigation as part of the corruption and influence-peddling scandal centered around disgraced Washington lobbyist Jack Abramoff, and his policy issues including Indian gaming. Pombo has taken more money from Abramoff than any other member of Congress ($500,000). Fundraisers organized by Indian gaming interests and tied to the 2005 MLB All-Star Game are among those activities under scrutiny.[20]

On January 8, 2006, the Los Angeles Times alleged that Pombo helped one of Abramoff's clients, the Mashpee Indians in Massachusetts, gain official recognition as a tribe. In return, Pombo received campaign contributions from both the tribe and Abramoff.[21]

In the 2006 cycle, Abramoff was one of the top donors to Pombo's political action committee.[22] Several of Pombo's top five donors are political influence brokers from Detroit, Michigan who mingled gambling with major league baseball when they hosted several $5,000 per person fundraisers for Pombo in their owners box at Comerica Park during the 2005 MLB All-Star Game. News reports indicated contributions from the two day fundraising event would go to RICH Political Action Committee; however, FEC reports filed by RICH PAC show only one such contribution and apparently contributions were diverted to some other entity making it difficult to track who attended and contributed.

As it is, the Ilitch family, owners of the MLB Detroit Tigers and Detroit's MotorCity Casino, are also financial backers of various Indian Tribes including one (Shinnecock Indians) seeking to build an Indian casino in the Hamptons, Long Island, New York. Various issues and tribal disputes involving the Shinnecock were before the House Resources Committee chaired by Pombo just days after the fundraiser.[20]

On October 11, 2006 it was reported that Pombo "says he never worked with disgraced lobbyist Jack Abramoff in his fourteen years in Congress, but billing records suggest at least two interactions between the two in 1996."[23]

Guess who made almost the same exact contributions during the same period of time?

Glenn Marshall Indicted
 
U.S. Attorney Michael J. Sullivan’s office is alleging that Marshall, as chairman of the Mashpee Wampanoags, worked with controversial lobbyist Jack A. Abramoff, who allegedly advised Marshall and his tribe to “make significant political contributions to certain Members of Congress’’ in order to build support for tribal recognition that’s required before any casinos can be built on tribe-owned land.

Please don't fault the Feds for taking so long.  They're still investigating some of the things Abramoff did, but it's like dominoes - one pig squeals, the squealed on pig squeals, and the next in line has something else to offer.  This is just the beginning of some great
local soap opera, with familiar names attached. This could be interesting!

The Lights Out On Lantern Hill

"Lantern Hill is no Longer a quiet place to hike and to sit at the top and watch birds soar on the warm updrafts, and the roads are not places for children to ride with their families down to the beaches." - Jennifer Ryan, conservation biologist and legislative director of the Mass Audubon.
 
Where is Lantern Hill, do you ask?  Ledyard CT, that is where.  It over looks Foxwoods Casino.  This is a wonderfully written story of the heartache of seeing the environment altered and degraded by what she calls, "A conglomeration of structures that falls somewhere between the Wizard of Oz's Emerald City and Superman's Fortress of Solitude." 
Right now this story is only in the Winter 2008-2009 print edition of Sanctuary, The Journal of the Massachusetts Audubon SocietyGambling with Nature, The enviromental effects of mega-casinos.
It won't be accessible on-line for another month.  One piece by the editor, John Hanson Mitchell, tells a more abbreviated tale, Endgame, which you can read now.  He notes the following:
On the road just in front of the grand entrance, he saw a dead fox, its full bushy tail lifting and falling in the wake of the indifferent passing cars and buses.
Do those who propose a casino resort in the middle of rural Middleborough think this won't happen also?  Most don't because they think of it at all.  Others think it will be "done right".  Well, it hasn't been done right yet.  I'm still waiting to see it "done right."  Others don't care at all.  They only want the jobs or town revenues.  They don't care about the costs.  As noted by Ruth Geoffrey, Middleborough's town planner and the Mashpee Tribe's casino queen, in Before the Deluge:
"Trying to preserve all of these things (a community's rural and cultural roots) isn't easy."
She thinks she can do it.  I severely doubt it.
 
I recommend getting a copy of Sanctuary, especially if you can't wait the month for it to come all on-line.  All the pieces are excellently written, diverse in perspectives and well researched.

Pay-To-Play
 
Why is it that somehow, some way or another gambling is involved with political and government corruption?  Is this a rhetorical question?  Yes, the feds have busted another one and today it is Illinois Governor Rod Blagojevich.  Come on down.  You're the next contestant on Caught Making a Deal.  Read the summary here.
 
To quote from the full criminal complaint starting on page 41. (Emphasis mine):

Later in the conversation, ROD BLAGOJEVICH stated that heknows Lobbyist 1 is “down there (Springfield, Illinois)” with Contributor 1 “pushing a bill.”  In a series of calls since that time, it became clear that the bill Lobbyist 1 is interested in isin the Office of the Governor awaiting ROD BLAGOJEVICH’s signature. The bill (probably SB 2702 and/or HB2651), which is believed to be a law which involves directing a percentage of casino revenue to the horse racing industry, is expected to be signed as soon as next week. In a call on December 3, Lobbyist 1 advised ROD BLAGOJEVICH that Lobbyist 1 had a private conversation with Contributor 1 about the contribution (“commitment”) Contributor 1 had not yet made and advised Contributor 1 “look, there is a concern that there is going to be some skittishness if your bill gets signed because of the timeliness of the commitment” and made clear that the contribution “got to be in now.” ROD BLAGOJEVICH commented to Lobbyist 1 “good” and “good job.” In a call the next day, Lobbyist 1 asked ROD BLAGOJEVICH to call Contributor 1 “just to say hello, I’m working on the timing of this thing, but it’s gonna get done.” Lobbyist 1 suggested that it is better for ROD BLAGOJEVICH to make the call personally “from a pressure point of view.” ROD BLAGOJEVICH stated that he would call Contributor 1 and indicate that ROD BLAGOJEVICH wanted to do an event (fundraiser) downstate “so we can get together and start picking some dates to do a bill signing.” Lobbyist 1 assured ROD BLAGOJEVICH that Contributor 1 would be good for the donation because Lobbyist 1 “got in his face.”

Contributor 1 is listed on the Friends of Blagojevich spreadsheet as someone from whom Friends of Blagojevich was seeking $100,000 in contributions and Lobbyist 1 is listed as one of the contacts for Contributor 1.

What a piece of work.  Can't let "timing" spoil a good fundraiser and gambling bill signing, can we?  Jobs for the wife, picks to replace President-elect Barak Obama's US Senate seat, nice union job when out of office, sweet heart deals for contributors and lobbyists and never forget the gambling industry.  You just can't make this stuff up.  It falls right into your lap.

Last Call?
 
“What I think you’d see ... are people leaving bars and going to the casinos to extend the party.” - Preston CT First Selectman Robert Congdon.
 
Not if the host and surrounding communities have any say in the matter.  24 hour boozing and gambling, what a money making combination for Foxwoods and Mohegan Sun.  There is always some "open minded" pol who is willing to look at the prospect, like Ledyard Mayor Fred Allyn Jr.  In other words, "What's in it for me?"  Or "How much money can we can get to fill in government revenue shortfalls?"  Somehow it is always about money to be made at any cost. 
 
At least the editorial staff of The Day understands the real impact.  Two things will no doubtedly happen.
1)  As noted, those who want to continue drinking after 1 or 2 AM will leave local establishments (possibly drunk already) to go to drink more at the casinos and leave drunker than they entered, and...
2)  They will skip going to local establishments all together and just drive to Foxwoods & Mohegan Sun and stay.  This of course would negatively impact the revenue of the local business.
This is another way to kill off local competition of any kind, not just from Atlantic City as the casino mouth pieces purpose.  Plus, it is a whole lot easier to get all the cash out of drunk customers than it is from sober ones.
 
CT doesn't need more drunk drivers or closed local businesses from that kind of uneven playing field.  Oh the wonder of it all.
