THE WILL OF Abigail Heim

 

In the name of God, Amen, I Abigail Heim of Frederick County, State of Maryland, being of Sound and disposing mind, memory and understanding and being anxious to settle my worldly affairs, before it should please God, to call me hence do make and constitute this my last Will and Testament [that is to say First and principally I commit my soul into the hands of Almighty God, who gives it and my body to be decently buried by my Executor herein after named. It is my will that all my just debts and funeral charges be fully satisfied and paid by my Executor hereinafter named. Item. I bequeath the rest and residue of my Estate Real, personal, and mixed to be equally divided between the children and Grand children of my late husband Andrew Heimes, as follows to wit: David Heim, John Heim, George Heim, Andrew Heim, Mary Lambert, Barbara Boswell and the children of Elizabeth Ridgely, the children of Elizabeth Ridgely to have one seventh part of said Estate to be equally divided between them share and share alike. And lastly I constitute and appoint my Stepson Andrew Heim Executor of this my last Will and Testament and revoke all other Wills by me hereuntofore made and declare this to be my last Will and Testament - In witness whereof I have herunto set my hand and affixed my Seal this thirty first day of December Eighteen hundred and thirty one - Signed, Sealed, published and declared by the Testatrix, to be and contain her last Will and Testament, in presents of us the Subscribing, who, at her request and in her presents subscribed our names as witnesses thereto: Henry Nidorff, John Lugenbeel, Whereas I Abigail Heim of Fredeick County have made and duly executed my last Will and Testament in writing bearing date the 31st of December 1831, which said Will and Testament and every clause, bequest and devise therein contained I do here by ratify and and confirm [Saving and excepting such clauses , bequests and devised therein mentioned as are by me hereafter revoked and made void] and being desirous to alter some parts thereof do therefore hereby make this my codicil which I Will and direct shall be taken and held as part of my said Will and Testament in manner and form following, that is to say. Whereas Andrew Heim in the Settlement of his Father's estate over paid George Heim, John Heim, and Elizabeth Ridgely and is likely to loose by them I therefore direct and devise, that part Andrew Heim & his heirs and assigns forever and that the said Andrew Heim, be entitled to four seventh parts instead of one seventh thereof as by my said former Will and do hereby revoke so much of my former will as gave the said George Heim, John Heim, & Elizabeth Ridgely children each one seventh part of my said Estate. In testimony thereof I have hereunto set my hand and affixed my Seal this twenty-first day of November one thousand eight hundred and thirty-two.
Abigail Heim [her mark] Signed, Sealed, published & declared by Abigail Heim the above named Testatrix, as & for a codicil to her last Will and Testament, in the presents of us who at her request and in her presents, and in the presents of each other have subscribed our names as witnesses there to: John Lugenbeel, Henry Nixdorff [Maryland, Frederick County, To Wit - On the 31st day of May 1834, came Henry Nixdorff, and made oath on the Holy Evangely of Almighty God that the foregoing Instruments of Writing are are the true whole Will & Testament and Codicil of Abigail Himes, late of Frederick County deceased, that has come to his hands and possession, that he received the same from the Testatrix for safe keeping, and that he does not know of any other. Test G. W. Eichelberger Regr. On the 10th day of December 1834, came Henry Nixdorff one of the subscribing witnesses to the foregoing last Will & Testament & Codicil of Abigail Heim, Dec'd, and made oath on the Holy Evangely of Almighty God, That he did see the Testatrix therein named Sign and Seal said Will & Codicil That they heard her publish, pronounce and declare former to be per last Will & Testament and the latter to be a Codicil to her said last Will & Testament. That at the times of her so doing, she was to the best his apprehension of sound & disposing mind, memory and understanding. That he subscribed his name as a witness thereto at the request of the Testatrix and in her presece and that he did also see John Lugenbeel, the other subscribing witness subscribe his name as a witness to said Will & Codicil at the request of the Testatrix and in her presence, and in the presence of each other -Test G. THE WILL OF Andrew Hyme
In the name of God, Amen; I Andrew Heims Senior being sick and weak in body, but of sound mind memory and understanding and considering the certainty of death and the uncertainty of the time thereof, and to the end that I may be the better prepared to leave this world when it shall please God to call me hence, do make and publish this my last will and testament in manner and form following, that is to say; - First, & principally, I commend my Soul into the hands of Almighty God, my body I commit to the earth to be decently interred by my executors hereinafter named and after the payment of my funeral charges and all my just debts, I give and bequeath as follows to wit. - Imprimis. I give and bequeath unto my beloved wife Abigail the House adjoining and on the east side of my present dwelling, one bed, one chest, one beauro, one table, three chairs so much kitchen furniture as my Executors in their discretion may deem sufficient for her conveniency in House keeping and one stove; during her life or so long as she remains unmarried; Item. I order and Direct that the residue of my property both Real and personal be sold by my Executors to the best advantage so soon after my death as the same may be conveniently done, and the one third of the money arising from the said sale, as also one Interest for my said wifes use. Item. I order and direct that my Executors apply so much of the principal to my said wifes use as they in their judgment may deem necessary for her decent support and comfort during her life and at her death the residue thereof to descend in equal proportions to my Seven Children herein after named and theirs; Item. I give and bequeath unto my said seven children, vizt. David Heims, John Heims, Andrew Heims, Mary Lambert, Elizabeth Ridgeley, and Barbara Boaswell the Residue of my estate Real personal and mixed in equal share after deducting from Barbara Boaswell's share seventeen dollars, and after having the following legacies viz. To Rezin Manspecker One Hundred Dollars. To John Manspecker One Hundred Dollars. To Daniel Manspecker, Junior One hundred dollars. To Andrew Manspecker One Hundred and twenty-five dollars, To Andrew Heims, son of George Heims, twenty five Dollars. Item. I order and direct that the money or share of my Estate coming to Barbara Boaswell be placed at Interest by my Executors at Interest for her use and should the Interest be insufficient for her support, I order and direct that my Executors apply so much of the principal thereof as they may deem sufficient for that purpose whilst she remains unmarried upon which event the same to go to her Children by William Boaswell her late Husband - Lastly, I do hereby appoint my Son Andrew Heims and my friend John James McCulley Executors of this my last Will and Testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this fourteen day of February eighteen hundred and eighteen. Andrew Heim Signed, Sealed, published and declared by the above named Andrew Heims Senr. to be his last Will and Testament in presence of us, who have hereunto at his request and in his presence subcribed our names as witnesses - John Ebert, Henry Nixdorff Frederick County, to wit: On the 7th day of June 1819, then came Andrew Heim & John McCulley and made oath on the Holy Evangely of Almighty God that the foregoing instrument of writting is the true whole will & Testament of Andrew Heim Senior of Grederick County deceased that hath come to their hands & possession and that they do not know of any other - Frederick County to wit: On the 7th day of June 1819 then came John Brunner, John Ebert, Henry Nixdorff, the three subscribing witnesses to the foregoing last Will & Testament of Andrew Heim Sr. late of Frederick County, deceased and made oath on the Holy Evangely of Almighty God that they did see the Testator therein named sign & seal this Will that they heard him publish, pronounce & declare the same to be his last Will & Testament, that at the time of his so doing he was to the best of their apprehensions of a sound & disposing mind, memory & understanding, that they respectively subscribed their names as witnesses to this will in the presence and at the request of the Testator and all in the presence of each other. Henry Steiner reg'r. [Frederick County Wills] The family resided at Frederick Co., Maryland. The marriage and birth records were taken from Fredrick Lutheran Church and Fredrick German Reformed Church.


THE WILL OF David Hime (Heim)


Whereas it is appointed unto all Men once to Die and Time uncertain when in consideration of which Truths I, David Hime, of Frederick County and state of Maryland being now of Sound and Disposing Memory, do make this my Last Will and Testament in Manner and form following,Viz: Imprimis. My will is that all my just Debts be first paid faithfully and my body buried in a descent and Christian like manner by my Executors hereafter named.
Item. I leave the _______ of all my Estate bouth Real and Personall to my Beloved Wife Margret Hime during her Natural Life to be Possessed and Enjoyed by her without Molestation or Hinderance of any Person whatever proved [?] she lives a widow, but if she marys again or Dies, then my Will is that all my Estate be Equally Divided between all my children to wit. --Andrew Hime, Lorance Hime, Barbary Stockman, and Pagey Whaskey, to them their Heirs and Assigns for Ever and Lastly I do hereby constitute and appoint my two Son-in-Laws George Stockman and George Whaskey Joint Executors of this my Last Will and Testament and I do hereby Renounce and make Void all other Wills by me heretofore made - In Witness whereof I have hereunto Set my Hand and Affixed my Seal this twenty-sixth Day of January in the Year of our Lord One Thousand Seven Hundred and Eighty-six. David Heim Signed, sealed, acknowledged Delivered as his Last Will and Testament before us the Subscribs: Michael Rommer, George Brickhartt, Johann Bockins Frederick County - 31 January 1786 There came George Stockman and George Whiskey and made Oath that the aforegoing Instrument of Writing is the True and Whole Will and Testament of David Hime late of Frederick County Deceased that hath come to their Hands and Possession and that they doth not know of any other. - George Murdock Regr. The came Michael Romar, George Brickhartt and John Bockins the three ubscribing witnesses to the aforesgoing last Will and Testament of David Heim late of Frederick County Deceased and severally made Oath that they did see the Testator therein named Sign and Seal this Will they heard him publish, pronounce and Declare the same to be his last Will and Testament, that at the time of his so doing he was to the best of their Apprehensions of Sound and Disposing Mind, Memory and Understanding that they Respectively Subscribed their Names as Witnesses to this will in the presence and at the Request of the Testator and in the presence of Each Other. - George Murdock Regr. [Frederick County Wills: Liber, pages 202-204] On 31 January, he was buried at the Olivet Lutheran Graveyard in Frederick.
The Heim family is of Dutch Ancestry. David immigrated from Heimburg, Nassau, Holoischen, Germany to Philadelphia, Pennsylvania. An Andreas Heim, a possible brother, is found in the church of St. Michael's & Zion Church in the 1750's as was David. On 10 March 1755, David Heim & Maria Margaretha were sponsors for Maria Maragretha Lutz, daughter of Jurg Michsael Lutz & Anna Wallpurgia [four miles out of town] in St. Michael's & Zion Lutheran Congregation in Philadelphia. On 24th of September 1764, David Heim of Northern Liberties, Philadelphia County was naturalized in Philadelphia. Later, the family resided in Frederick County, Maryland. When David died, he left his wife, four surviving children & 23 surviving grandchildren.


THE WILL OF Johan Lorenz (Lawrence) Heim

In the Name of God, Amen. I Lawrence Hime of Frederick County and State of Maryland being weak in body but of Sound and Perfect Mind and memory thanks be to the Almighty God for the same to make and publish this my last Will and Testament that is to say - First it is my will and desire that all my just debts and funeral charges shall be paid out of my personal Estate - Item: I give and bequeath the whole of my Estate both real and Personal to my wife Christina Hime during the minority of my three children hereafter named but if my said wife should die or get married during my said children's minority that it is my will and desire that my Executor hereafter named Shall take charge of my said Estate and manage it for the benefit of my said three children. Item: I give and bequeath to my three children Mary, George and John Hime their heirs and assigns forever the whole of my Estate both real and personal after the payment of my Just Debts and funeral charges but if either of my said three children should die under age or without issue then and in that case it is my Will and Desire that his her or their share or portion [so dying] shall go to the Survivor or Survivors share and share alike. And lastly, I do hereby constitute and appoint my wife Christina Hime Executrix and my friend Matthias Buckie Executor of this my last Will and Testament hereby revoking all former will by me heretofore made. In witness whereof I have hereunto subscribed my name and affixed my Seal this fifth day of March in the year of our Lord one thousand seven hundred and ninety-four. Laurence "X" Hime [his mark} Signed, Sealed, Published and Declared by the within named Laurence Hime to be his last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the said Testator and at his request. Allen Quynn Jr., Christian Scholl, Henry Cox Frederick County June 6, 1797, Then came Christina Hime and made Oath that the aforegoing Instrument of writing is the True and whole will and Testament of Laurence Hime late of Frederick County Deceased that hath come to her hands and possession and that she doth not know of any other. George Murdock Regr. Frederick County June 6, 1797. Then came Allen Quynn, Jr., ChristianSchool, and Henry Cox the three subscribing witnesses to the aforegoing last Will and Testament of Laurence Hime late of Frederick County deceased and made Oath that they did see the Testator therein named Sign and Seal this will that they heard him publish, pronounce, and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their apprehension of a Sound and disposing mind menory and understanding that they respectively subscribed their names as witnesses to this will in the presence and at the request of the Testator and all in the presence of each other. THE WILL OF Michael Helms, II


Will filed January 22, 1878, on record at Richmond, Indiana
I bequeth to my son Isaiah Helms the following real estate situated in Wayne County, Indiana, it being the Northeast quarter of Sec. 23, TWP. 15, Range 13, known as the Homestead, it being 157 1/2 acres more or less. I further bequeath to my son Isaiah all the household goods that belong to the house I now reside in, for which he is to maintain me during my lifetime and likewise his share of the personal property. I wish it to be understood this to be his full share. The rest of my real and personal property is to be distributed equal among the balance of my heirs. I appoint my son, Isaiah Helms, and Philip Jenkins executors of this my last will and testament. Witnesses: Robert T. Fulton, George G. Ranck


THE WILL OF Abner H. Hixson


Will of Abner H. Hixson signed 2 Mar 1883 found in Loudoun Co., VA Transcribed from photocopy of original document and submitted by Carol Phillips, phillips@sundial.net ******** March 2nd, 1883 I A.H. Hixson being in sound mind do will and bequeath to my daughter Cecil R. Davis and her children all money coming do from my uncle David Hixsons estate, the said money to be laid out in a home for her and her children to hold during her natural life and to be a home for her children until her youngest shall become twenty one years of age, and then shall be divided amoungst them equally. I appoint my nephew John Hutchison my admr. and to carry out my last will. I further request to be buried in the Hixson burying ground on the farm of Mullin Rodgers and I further more request that my body shall be wrapt in a gray soldiers blanket and in a colous coffin, pine or poplar without being plained. Will of Timothy HIXSON signed 5 Sep 1811 found in Loudoun Co., VA Will Book K, Page 89 ******** In the Name of God Amen I Timothy Hixson of Loudoun County and State of Virginia Farmer being of sound mind and memory Calling to min the uncertainty of Life knowing that it is appointed for all men to Die Do make and ordain this my last will and testament as it hath Pleased God to Bestow upon me somewhat or the Goods of this world I have thought fit to Dispose of them in the Following manner First of all my Funeral Charges and Lawful Debts be paid Item I Give unto my Beloved Margaret Hixson Her Thirds in the Plantation I now live on to have the mention house that I Live in also one third of my movable Property but what I shall mention hereafter to be Returned at Her Death also one third of the Plantation I Bought of Capt. John Hambelton also Forriston and Kate his wife to work for her support to be her Share of the Slaves the Land and negroes the whole to be Returned at her Death to go as I shall Direct with the increase of the slaves. Item I Give unto my three Sons Samuel and Andrew and Flemon Hlxson the Plantation that I live on with that I Bought of John Hambelton with all my movable Estate with my slaves also what I may be Possessed of at my Death the Land is to be Payed for by them and all my Lawful Debts if not Done in my Life time to be Equal Shares to my three Sons, above named but what I shall otherways Direct my wife to have Flemons part untill he arrives to the age of twenty one years or should marry:- Item I Give to my Daughter Elonor Hixson Hixson to be paid out of my Estate two Hundred pounds and a negro Girl named Phillis if the Girl should be Living when Elonor arrives to the age of twenty one if not to hsve the worth of such a girl Paid her by my three sons above mentioned Equal alike also one feather Bed and Bedding Case of Drawers also a Cow and horse and Saddle and other things so as to Begin housekeeping she is to have them when she arrives to the age of twenty one or when she marrys the money not to be Called for without on hand in less than twelve months after my Death to be Paid her by my three sons above named if any of the above mentioned sons should Die before they arrive to the age of twenty one or should lave Lawfull Issue it shall be Divided amongst them that survives and their heirs. Item my will is that the Price of the Plantation that I Got of my son Rewben Hixson which my wife nor the abovementioned Children to have no Claim to nor Part in which I have sold for Fourteen Hundred Pounds to go to my first wifes Children sons and Daughters, as I shall Direct the Price of said Land to Go. Elijah Hixson to have 30 pounds if living at Death if not to his son Timothy Hixson or his heirs, Ruben Hixson heirs his Daughter Jean Rachel Mary Catherine to have 50 pounds to have Equal alike Having have done more for him than the Rest which is the Reason for not making him Equal with the Rest and John Hixson, William Hixson, Benjamin Hixson, Timothy Hixson, Sarah Hixson, Rachel Davis Mary King Margarett Gregg the Price of the said Plantation to be Eqally Divided amongst them except Wlliam to have £50 the most being a Cripple Land that I Bought of henly Boughgese and he of Ja. Binns said Binns Bought himself to make a good and Sufficient Deed for which he has not done if taken away by older Claims to Return the money with the intust Bought in the 1797 which the article will shew the Sum I Gave 180 pounds which Land or the money to go to my that I shall name them to my first wifes children Elijah Hixson if he should Living at My Death if not to his son Timothy Hixson 200 acres if a deed is Got if not his Part of the money that was paid for the Land with intust Reuben Hixsons sons Stephen and Noah 200 acres or their Part of the money Equal John Hixson 200 acres if not an equal part of the money William Hixson 200 if not his Part of the money Equal Part Timothy Hixson 200 acres if not an equal Part money and Benjamin Hixson he to have a tract of Land in Harrison County Virginia which have a deed for to be his part in Land the part of the above is 1000 acres in flemon county Caintucky on Indian creek the money that hatch Been advanced To any of them the Bonds or notes to come out of their Part or open accounts will shew to come out of the Price of the said Plantation sold the Balance If I should not make Distribution in my Life time go to my three sons Samuel and andrew and Flemon Hixson Do appoint my Beloved Wife Margarett Hixson Hixson my Executors of my Last will and Testament Revoking all other Wills by me heretofore made Confirming this and this only to be my Last will and Testament Given under my Hand and fifth Day of September one Thousand eight Hundred and eleven. THE Last Will and Testament of George Hoop, Jr.

 

The following is the will of George Hoop dated Jan. 3rd, 1831 page #337, probated Jan. 21st, 1831 In the name of God Amen. I George Hoop Jun'r of the County of Bedford State of Pennsylvania, being of sick and week body but of sound mind and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs, and thereby be better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following (That is to say ) First and principally I commit my soul into the hands of Almighty God, and my body to the earth to be decently buried at the discretion of Executors herein named, and after my debts and funeral are paid, I devise and bequeath as follows - I give and bequeath to my beloved Wife, Mary, all and every thing that was hers when she intermarried with me. I also give and bequeath to my said Wife forty dollars to be paid out of my personal estate, when sold and turned into money. Also seven bushels baskets of rye, three bushels of wheat and thirty pounds of pork. It is my will and desire that after my Wife’s legacy is taken out and my just debts are paid, that the remainder of my personal estate and all my outstanding debts be equally divided between my five daughters viz: Elizabeth, Mary, Sarah, Anne and Catharine, share and share alike. ~ It is further my will and desire, that my land be sold by my executors herein mentioned, in the best way and manner as they may think proper, and the amount of sale after taking out expenses, to be equally divided between my four sons John, Jacob, Adam and David, share and share alike. And lastly, I do hereby constitute and appoint my son John Hoop and David Sharp Executors of this my last will and testament, revoking and annulling all former wills by me heretofore maderatifying confirming this and none other to be my last will and testament. In testimony whereof I have set my hand and affixed my seal this 3rd day of January in the year of our Lord one thousand eight hundred and thirty one. ----- Signed, Sealed, published and declared by George Hoop the above named testator as and for his last will and testament, in the presents of us who at his request, in his presents and in the presents of each other have sub= scribed our names as witness thereto - H. B. Hammett, George "X" Sharp Bedford County, Personally appeared before the subscriber Register for the probate of Wills and granting Letters of Administration in and for said County, William B. Hammett and George Sharp, the subscribing witnesses to the foregoing instrument of writing and being duly sworn according to law depose and say that they were personally present and heard and saw the testator George Hoop, sign, seal, publish, pronounce and declare the foregoing instrument of writing as and for his last will and testament, that at the time thereof that the testator was of sound and disposing mind, memory and understanding according to the best of these deponants knowledge and belief and that they subscribe their names thereto as witness in presence of the testator and at his request.
