THE WILL OF JACOB WEEKLEY
In the name of God Amen I Jacob
Weekley of the County of Shenandoah knowing the uncertainty of human life think
proper to dispose (dispense?) of the property God has pleased to blefs (bless)
me with in the manner and form following to wit my desire is that my children,
William, John, Enoch, Elijah, Sally, Susannah, Nancy, Jacob, Joseph, Thomas,
Robinson and the heirs of Isaiah dec'd all to have an equal part of my estate
after my just debts is paid except the last mentioned heirs and they to have
only half as much as the above mentioned children out of my estate and Winifred
one third part with the above mentioned equal parts and Catharine and Elizabeth
the sum of one dollar in consideration of their having had a proportionable part
of my estate all ready my desire is that my daughter Sally shall have the ceare
of my daughter Susannah as long as they both may live, my desire is also that if
any of my mentioned children should die without lawful ifsue (issue), that part
of my estate shall return to the surviving ones that is to have an equal part of
my estate knowing all other wish or wills heretofore made by me as witness my
hand and seal this tenth day of April one Thousand Eight Hundred and Twenty
One.

in the area)

At court held for the County of Shenandoah on Monday the 10th Day of May
1824. This last will and testament of Jacob Weekley dec'd was further proved by
the oath of Alexander Finnell as witness thereto and ordered to be recorded.

I have changed the names of the witnesses to Finnel based on the fact that
Alexander and Reuben were in fact neighbors of Jacob and are buried in the
Finnell Cemetery near Happy Creak on what is now the Conservation Research
Center, aka Cavalry Remount Depot, off Route 522 South of Front Royal, VA.

The Last Will and Testament of
Margaret Weekley
In the Name of the Benevalent Father of All.
I, Margaret Weekley of
the City of Newark, County of Licking and State of Ohio. Being of sound
disposing mind and memory, and considering the uncertainty of human life, do
make and publish this my last Will and Testament, revoking all others by me
made.
1st. My Will is that all my just debts and funeral charges shall 1st be
paid.
Item 2nd. I give and bequeth to my beloved Son John W. Weekley One No.
9 Cook stove with all the utensils connected with it, one lounge with
bedclothes, tick, spread pillows and colored quilt, the said goods are in my
house in Elizabethtown Licking Co. and also one third of all money I may have at
my death, it now being in a $750.00 note made by John Hoover and due me.

3rd. To my beloved Daughter Julia Ann Dunn I give and bequeth the kitchen stove
all kitchen utensils in her house in Newark O. the carpets on the floor and one
half the Dishes now in my possession, and one third of all monety I may have at
my death it now being in a $750.00 Note made to John Hoover and due me, and one
bed and Bedding and bedstead.
Item 4th. To my beloved Daughter Margaret Hupp
I give and bequeth one half of the dishes in my possession and one third of all
money I may have at my death, it being in a $750.00 note made by John Hoover and
due me, also about 40 yards of carpet at my house in Elizabethtown. I also give
and devise to said Margaret Catherine Hupp all my real estate in Elizabethtown
consisting of one house and lot which I have made a deed for to said Margaret
Hupp now in the possession of Hugh Fleming.
Item 5th. To my beloved
GrandDaughter Dora Hupp I give and bequeth one feather bed one straw bed,
bolsters and pillows two quilts 1 Blanket one bed stead and one Rocking Chair,
two Sheets and one comfort and one 50 dollar note due me from Dr. Hornby, one
half due in August 1893 and the balance in August 1894.
Item 6th. To my
beloved Grand Daughter Clara Hupp I give and bequeth two Windsor chairs one
bureau.
Item 7th. To my beloved Grand Daughter Ollie Hupp I give and bequeth
one table.
Item 8th. To my beloved Grand Daughter Margaret Wright I give and
bequeth 1 stand, 1 safe and Kitchen chairs.
In whereof I have signed sealed
and published and declared this my last Will and Testament this 24th day of June
1893.

An application to Probate the Will was filed by Alfred T. Dunn (husband
of Julia A. (Weekley) Dunn, daughter of Elias) on November 14, 1893 in the
Probate Court of Licking County, Ohio. In the application, the following next of
kin are cited. John W. Weekley, son of Fallsburg, Ohio; Julia A. Dunn, daughter,
of Newark, Ohio; Catherine C. Hupp (We have her listed as Margaret Catherine),
daughter, of Newark, Ohio; the following grandsons; Tolliver Thrailkill, Thomas
Thrailkill, Milo Weekley, Charles, Ira, John and Alva Willey; Grandaughters;
Jane and Dora Willey, Lucinda Scott, and Dolly Miller. The Thrailkills lived in
Columbus, the Willey's and Millers in Reform and Milo Weekley at Dudgeon's
Corner.
